At the beginning of the month, the Moroccan government has adopted a draft decree at the land registry regarding the reassessment of rates. Said the decree number 2-16-375 amended and supplemented by Decree No. 2-16-645 which was adopted late last month. It is applied since last week.
Land registration had not seen its rates be reassessed since June 1997 almost 20 years! These rates allow compensation for the services, legal and technical rights including fixed and ad valorem duties. New judgments announced a 1.5% increase on the ad valorem duties is one of the lowest rates in the world, according to the Moroccan State.
The decree does not change that rate … but much more!
Apart from this rate from 1% to 1.5% for those rights, the most important amendments of the draft Order is to encourage land registration in rural areas through tariff reduction.

Apart from the ad valorem duty levied on registration that is 1.5%, the fixed fee per well has risen from 75 to 100 dhs and a minimum charge rounded 500 DHSS. For leases, the ad valoremest duty is calculated on the basis of the amount of total rent during the baul. The fixed fee per well in case of inheritance is 100 dhs.
Regarding inheritance shares, whether registration or deposit is made within 2 years after death, the fixed duty per property is 500 dirhams, while it is charged on the rights due to topographical operations When appropriate . The law announces that if the period of two years is exceeded, the ad valorem duty will be 1.5%, in addition to 100 dhs fixed by law well. When appropriate, the first shall be charged on the rights due to topographical operations.
Mortgages for real estate loans are changing …
For multiple registration in multiple land conservations, the decree shows that people will only have to pay a fixed fee of 500 dirhams, levied on production of the receipt or its duplicate from the land registry which levied rights due.
Reduced mortgage registration fee is also applicable for mortgages of less than 250,000 dirhams or above 5 million dirhams. In both cases, a rate of 0.5% will be applied while it will be 1.5% for goods whose amount is between these two values.
The decree also innovates with specific provisions to contracts of “Murabaha” and “rent-home ownership.” For “Murabaha, the charge will be 1,000 dirhams per well. For accession-hire during the transfer of the leased property to the customer, the fee is set at 500 dirhams.
If you want a duplicate of the title deed or special certificate (loss, steal, destroy …), you will débrouser 250 dirhams of right of publicity, right of 50 dirhams per page, 100 dirhams fixed right and 100 dirhams for copy of the land plan for a new duplicate. The establishment of a new special certificate will cost 250 dirhams advertising law in more than 100 dirham fixed duty.
